Malaysia TERMS OF USE
1. Introduction
Welcome to the iBidan platform (“Platform”), operated by iBidan Pte. Ltd. (“Company”, “we”, “us”, or “our”).
By accessing or using the Platform, you agree to be bound by these Terms and Conditions (“Terms”).
2. Platform Role
The Platform is a technology and service platform that facilitates connections between customers and independent service providers (“Bidan”).
The Company:
- does not provide, perform, or control any services;
- is not a healthcare provider; and
- acts solely as an intermediary and booking facilitator.
All services are provided independently by the Bidan.
3. Eligibility and Use
By using the Platform, you confirm that:
- you are at least 18 years old;
- you provide accurate and complete information; and
- you will use the Platform only for lawful purposes.
4. Services
Services available on the Platform may include:
- postpartum care
- prenatal care
- wellness services
All services:
- are performed by independent Bidan;
- are subject to availability; and
- may vary depending on the Bidan.
5. Booking and Matching
- Customers may request bookings through the Platform or authorised communication channels.
- The Platform facilitates matching between customers and Bidan.
- A booking is confirmed only when accepted by the Bidan.
The Company does not guarantee:
- availability of services;
- acceptance of bookings; or
- specific service outcomes.
6. Pricing
- Prices displayed on the Platform reflect standardised service rates.
- Pricing may vary depending on service type, location, or promotions.
- Final pricing is confirmed upon booking acceptance.
7. Payment and Collection
- Payments may be collected by the Company on behalf of the Bidan.
- The Company acts solely as a collection agent.
- The Company retains a service fee, and the remaining amount is paid to the Bidan. The Company does not receive the full value of the Services as its revenue.
Where applicable, certain product components included in a package are supplied directly by the Company as principal and are not part of the Services provided by the Bidan.
The Company’s role is limited to facilitating bookings, payment collection, and related administrative support, and does not include the provision of the Services.
8. Cancellation and Refunds
- Cancellation and refund requests are subject to the iBidan Refund & Cancellation Policy.
- Customers are encouraged to review the policy before making a booking.
The Company may assist in coordination but does not guarantee refunds unless expressly stated.
9. Customer Responsibilities
Customers agree to:
- provide accurate and complete information;
- ensure a safe and suitable environment for service delivery;
- treat Bidan with respect and professionalism;
- comply with applicable laws and regulations.
10. Health and Safety Disclaimer
Services provided through the Platform are not a substitute for professional medical advice.
Customers should consult qualified healthcare professionals where appropriate.
11. Limitation of Liability
To the fullest extent permitted by law:
- The Company acts solely as a platform facilitating connections between customers and independent Bidan.
- Services are provided directly by the Bidan, who is responsible for the performance of such services.
- The Company shall not be responsible for the quality, outcome, or results of the services provided.
The Company may assist in coordination or communication but does not assume responsibility for the services performed.
12. Intellectual Property
All content on the Platform, including text, branding, and materials, is owned by the Company and may not be used without prior written consent.
13. Data Protection
The Company will handle personal data in accordance with Singapore’s Personal Data Protection Act (PDPA).
Personal data will be used only for service facilitation and related purposes.
14. Suspension and Termination
The Company reserves the right to suspend or terminate access to the Platform if a user:
- breaches these Terms;
- engages in misconduct; or
- poses a risk to other users or the Platform.
15. Amendments
The Company may update these Terms from time to time.
